CRITICAL SKILLS WORK VISA
 
A critical skills work visa may be issued to an individual possessing such skills or qualifications determined to be critical for the Republic of South Africa from time to time by the Minister of Home Affairs by notice in the Gazette and to those members of his or her immediate family as determined by the Director-General under the circumstances or as may be prescribed.

The following documentation must be submitted in respect of each person applying for critical skills work visa:
  • a fully completed application form and including two (2) passport photographs (see Form DHA-1738);
  • a passport valid for no less than thirty (30) days after departure from the Republic of South Africa, and containing at least two (2) blank pages;
  • a copy of passport, page with photograph;
  • proof that the applicant falls within the critical skills category in the form of –
  • a confirmation, in writing, from the professional body, council or board recognised by SAQA in terms of section 13(1)(i) of the National Qualifications Framework Act , or any relevant government Department confirming the skills or qualifications of the applicant and appropriate post qualification experience;
  • if required by law, proof of application for a certificate of registration with the professional body, council or board recognised by SAQA in terms of section 13(1)(i) of the National Qualifications Framework Act; and
  • proof of evaluation of the foreign qualification by SAQA and translated by a sworn translator into English.
  • In terms of section 19 (5) of the Act, the relevant employer shall ensure that-:
  • a foreigner is only employed in the specific position which the visa has been issued;
  • the foreign departs from the Republic on completion of his or her tour of duty and;
  • the applicant will at all times comply with the provisions of the Act and will immediately notify the Director General.
  • a yellow fever vaccination certificate, if the applicant travelled or intends travelling from or through a yellow fever endemic area: provided that the certificate shall not be required when the applicant travelled or intends travelling in direct transit through such area;
  • in respect of the applicant’s marital status or spousal relationship, the following documentation shall be submitted (certified copy with translation into English certified by Public Notary):

    a) a marriage certificate in the case of a married applicant;
    b) proof of a legal divorce or the death of a spouse in the event of a preceding marriage;
    c) a death certificate in the case of a widowed applicant;
    d) a decree of divorce in the case of a divorced applicant; or

  • in respect of minor dependent children accompanying the applicant to or joining the applicant in the Republic, the following documentation shall be submitted (certified copy with translation into English certified by Public Notary):

    a) an unabridged birth certificate;
    b) proof of adoption, in the case of an adopted minor;
    c) proof of guardianship or custody, in the case of a minor subject to guardianship or custody; or
    d) consent from the guardian, in the case of an unaccompanied minor;

  • a police clearance certificate, issued by the police or security authority in each country where the applicant resided for 12 months or longer since having attained the age of 18 years, in respect of criminal records or the character of the applicant, and this certificate shall not be older than six (6) months at the time of its submission;
  • a medical report (see Form BI-811), which shall not be older than six (6) months at the time of its submission;
  • a radiological report (see Form BI-806), which shall not be older than six (6) months at the time of its submission, and shall not be required in respect of children under the age of 12 years or pregnant women;
  • confirmation of the applicant’s valid mobile phone number and email address;
  • the non-refundable application fee of 23605 KZT;

NB: Please take note that under no circumstances will the Department of Home
Affairs refund any person under any given reason for services already paid for
or rendered. A copy of the transfer slip should be submitted together with
application, as proof of payment.

Note:
  • A  critical skills work visa shall be issued for a period not exceeding five (5) years
  • Documentation that accompanies the application shall be original or certified copies and translated by a sworn translator into English.
  • A complete application should be submitted personally during the consular opening hours: Mon-Fri; 09:00-12:30.
